Other standard reasons Heirs cannot get together to sell a property
The Problem With ‘Billy’:
First, ‘Billy’ is just a fictious name to identify an ‘heir’ that refuses to sign for various reasons.With several ‘direct heirs’ that are the children of the person that died, Billy is pissed off because his sister took mom’s jewelry and one of his brothers took dad’s car and he did not get anything extra of value. And further his other brother lived in the house ‘free’ for years not repairing the property and not paying taxes. So, he should get more than anyone else. “And” if the brother that did not at least pay taxes on the property, then his part of the profit from the sale will go to taxes that his brother should have at least paid. So he will not ‘sign off’ if that brother gets ‘anything’. So, ‘Billy’ is in control and assumes if he does not sign off, ‘no one’ will get any money.
And sometimes this dispute is for other reasons between heirs, but we see this a lot about a disgruntled heir or disagreement between heirs.
This is a ‘generic’ example of a typical heir hold out that is blocking a sale – thus causing serious problems for the neighborhood and specifically financial problems for the neighbors that are near the house and possible harm to their children.
The bigger issue is the heirs really don’t know or understand (or maybe don’t care) about the problems they are creating for so many other people.Contact Us
